4. Mandatory Arbitration

Any disputes arising from the use of our website or products shall be resolved through binding arbitration, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitrator will apply the substantive laws of the jurisdiction where Papa’s Herb has its principal place of business, without regard to conflict of laws principles.

  • Both parties must mutually select an arbitrator with at least five years of relevant experience within 10 calendar days of an arbitration demand.
  • If no agreement is reached, the AAA will appoint an arbitrator with the same qualifications.
  • The arbitrator’s decision shall be final and binding, with limited rights of appeal as provided under the Federal Arbitration Act (FAA).
  • Each party is responsible for their own arbitration fees, unless the arbitrator decides otherwise.
  • Attorneys' fees may only be awarded if authorized by statute or contract.
  • The arbitrator cannot award punitive damages, and both parties waive any right to seek punitive damages.

This arbitration agreement will continue to apply even if the agreement between the parties is terminated.

5. Waiver of Class Actions and Jury Trial

All disputes shall be arbitrated individually. By agreeing to these terms, both parties waive any right to:

  • Participate in class arbitration
  • Act as a class member in any class-action lawsuit
  • A jury trial in court

If a dispute proceeds in court instead of arbitration, it must proceed on an individual basis only.

This waiver remains in effect even if the agreement between the parties is terminated.

6. Compliance with Local Laws

Laws regarding hemp-derived products vary by state and are subject to change. We only ship our products to states where they are currently legal. However, Papa’s Herb reserves the right to:

  • Modify its shipping policies without prior notice
  • Restrict shipments to certain locations at our discretion

It is your responsibility to verify the legality of our products in your location before purchasing.
